Terms of Service
These terms are the agreement between you and ForemanPay. They cover the website www.foremanpay.me and the ForemanPay app. By creating an account or using ForemanPay, you agree to them. If you do not agree, please do not use ForemanPay. Effective date: October 2, 2026. If a translation says something different, this English version applies.
In short: ForemanPay calculates and keeps records. It does not pay anyone, and it is not a payroll or tax service. Paid plans renew automatically every month until you cancel. You can cancel online at any time from the Billing page. There are no refunds for a month that has already started, except for charges made in error. Sections 7 and 8 have the details.
1. Who we are
ForemanPay is run by Milan Fatić, an individual based in New York, USA. It is not a company. In these terms, "ForemanPay", "we" and "us" mean Milan Fatić.
For questions, support or complaints, write to support@foremanpay.me.
2. What ForemanPay is, and what it is not
ForemanPay is a calculation and record-keeping tool for moving crews working in the United States. You import your weekly payroll statement (the PDF that lists each foreman's jobs and pay; we call it a "statement"). You set each foreman's rate and each helper's share of a job. The app then calculates what each foreman and helper is owed. It also keeps a record of payouts, makes pay slips, and shows reports, history and yearly totals. It includes the Earnings page, the Job Log and a commission calculator.
- ForemanPay does not pay anyone and does not move money. "Mark as paid" only records a payment you made yourself.
- It is not a payroll service. It does not withhold taxes. It does not prepare or file tax forms, including the US 1099 form. Where ForemanPay says "payroll tracking", it means keeping track of the numbers on your statements.
- It is not tax, legal or accounting advice.
- A ForemanPay pay slip is a summary you share with your crew. It is not an official pay stub, wage statement or tax form. We do not check that it meets any labor or tax law.
- You decide how your workers are classified and paid. Following wage, tax and labor laws is your job, not ours.
- The numbers are a help, not a guarantee. They depend on the statement being read correctly and on the rates, helper shares and payouts you enter. Check every number, including yearly totals, against your own statements and records before you pay anyone or file a tax form.
3. Accounts
You must be at least 18. ForemanPay is for work and business use only.
There are two account types. A contractor account is for someone who runs a crew and pays foremen. A foreman account is for one person. When it imports a statement, it keeps only the lines under that person's own name. You choose the type when you sign up. You cannot change it yourself.
Each account has one email and password. It belongs to one company (contractor account) or one person (foreman account). Give accurate information. Keep your password safe and do not let anyone else use your account. You are responsible for what happens under your account. Tell us right away if you think someone else has used it.
4. What you upload
You are responsible for the statements and other information you put into ForemanPay.
Statements contain information about other people: the names and pay of foremen and helpers, and job names that can include a customer's last name. You confirm that you have the right to put this information into ForemanPay, and that you have told the people involved where the law requires it. If you have a contractor account, you also confirm that you may send each pay slip to the person it is for.
If someone named in your records asks us about their information, we may pass the request on to you.
5. Free trial
New accounts get a 7-day free trial with full access. We do not ask for a card. When the trial ends, we charge nothing. The trial does not become a paid plan automatically.
When the trial ends, your account becomes read-only. "Read-only" means everything stays visible, but you cannot import new statements or make changes. It stays read-only until you subscribe. There is one trial per account. If you subscribe during the trial, the paid plan and its first charge start right away.
6. Plans and prices
Paid plans are monthly and priced in US dollars:
- Starter: $13.99 per month. Contractor account, up to 6 foremen.
- Growth: $25.99 per month. Contractor account, up to 15 foremen.
- Unlimited: $39.99 per month. Contractor account, no foreman limit.
- Foreman: $6.99 per month. Foreman account, one person.
Prices do not include sales tax. If we have to collect sales tax where you are, it is added at checkout and shown before you pay. Current prices are shown on the Billing page, and the total is shown at checkout before you pay. Your paid plan starts as soon as Stripe confirms your payment.
The foreman limit counts the foremen who have jobs on your recent statements. If you have more foremen than your plan allows, new imports are paused until you upgrade. You can still view everything and change rates, helper shares and payouts. Deleting statements is paused too.
7. Billing and automatic renewal
Your subscription renews automatically every month, on or about the same day of the month you subscribed. Each time, Stripe charges your payment method the price of your plan, plus any sales tax. This continues until you cancel.
Your next renewal date is shown in Stripe's billing portal. To open it, go to the Billing page and choose "Manage subscription". To avoid the next charge, cancel before that date. Section 8 says how.
Payments are handled by Stripe. You enter your card on Stripe's pages. We never see or store your card number.
If we change the price of your plan, we will email your account address at least 30 days before the first renewal at the new price. The email will say how to cancel. If you do not cancel before that renewal, the new price applies from then on.
Contractor accounts can switch between Starter, Growth and Unlimited on the Billing page. The new plan starts right away. Stripe works out the price difference for the rest of the month and adds it to your next invoice, as a charge or as a credit. A credit lowers later invoices. It is not paid back to your card.
If a payment fails, your account becomes read-only right away. Update your payment method from the Billing page, and Stripe will try the charge again. If the payment still does not go through, Stripe may end the subscription. Your account stays read-only, your records are kept, and you can subscribe again.
8. Canceling and refunds
You can cancel any time, online. Open the Billing page and choose "Manage subscription". If a payment has failed, the button says "Update payment method" instead. Either one opens Stripe's billing portal, where you cancel.
You can also email support@foremanpay.me from your account email, and we will cancel it for you. If your email reaches us before your renewal date, you will not pay for the next month. If a charge goes through anyway, we refund it.
After you cancel, you keep full access until the end of the month you already paid for. Then the account becomes read-only. Your records are not deleted, and you can subscribe again.
We do not give refunds for a month that has already started, and we do not refund part of a month. There are two exceptions. A charge made in error, such as a duplicate charge, is always refunded. And if we close your account or shut ForemanPay down when you did not break these terms, we refund the part of the paid month you did not use (section 14).
Refunds go back to the payment method you paid with. To ask for one, write to support@foremanpay.me.
9. Pay slips and pay slip codes
You can make a pay slip for one foreman's week. Each pay slip has a pay slip code and a QR code. The pay slip shows that foreman's jobs, amounts, deductions, helpers and recorded payout for the week.
Anyone who is signed in to ForemanPay and has the pay slip code can see that pay slip and import it into their own account. The code works like a key. Give it only to the person the pay slip is for.
An imported pay slip is a separate copy in the other account. It stays there even if the statement it came from is later deleted.
A pay slip code stops working some time after the pay slip was last made or sent. Deleting the statement cancels its codes right away.
10. Emailed statements
Contractor accounts get an email import address, shown in Settings. Statements sent to it are imported automatically. Keep that address private. In Settings, list your trusted senders: the email addresses allowed to send statements.
We import an email only if it comes from a trusted sender, the sender is confirmed as real, and it carries a statement PDF we can read. Emails that fail these or our other checks are skipped, and we do not tell you. A week that is already in your account is not replaced by an emailed copy. Check the app to confirm that a statement arrived.
11. Acceptable use
Do not:
- use ForemanPay for anything illegal, or upload information you have no right to use;
- try to open another account's records, or guess pay slip codes;
- damage or overload ForemanPay, or test it for weaknesses;
- try to avoid the trial limit or the plan limits;
- copy or resell ForemanPay.
The ForemanPay app, its design and its name belong to us. While your account is open, you may use the app for your own crew's records. These terms give you no other rights in it.
12. Availability and changes to ForemanPay
We work to keep ForemanPay running, but we do not promise that it will always be available or free of errors. We do not promise backups, and we may not be able to bring back records that are lost. Keep your own copies of your statement PDFs and your Excel exports.
We may add, change or remove features. If we remove an important feature, we will tell you in the app or by email when we can.
13. Your records
What you enter is yours. You give us permission to store and process it only to run, support and protect ForemanPay, as our Privacy Policy describes.
You can export reports and history to Excel. To close your account and delete your records, email support@foremanpay.me. The Privacy Policy explains what is deleted.
14. Ending this agreement
You can stop using ForemanPay at any time. To cancel a subscription, see section 8.
We may suspend or close an account that breaks these terms, harms other users or ForemanPay, or where the law requires it. If we can, we will warn you first.
If we close your account for any other reason, or shut ForemanPay down, we will tell you in advance and refund the part of the paid month you did not use.
15. No guarantees, and limits on what we owe
ForemanPay is provided "as is". This means we give no guarantee that the numbers are correct, that the app has no errors, or that it is always available. As far as the law allows, we give no warranties of any kind, written or implied. This includes the implied warranties of merchantability, of fitness for a particular purpose and of non-infringement. You are responsible for checking the numbers and for what you pay your crew.
As far as the law allows, we are not responsible for lost profits, lost records, or other indirect or consequential losses. We are also not responsible for wrong payments, penalties or wrong tax forms that come from relying on the app. If we do owe you something, the most we will pay for all claims together is the amount you paid us in the 12 months before the problem happened, or US $100, whichever is more.
If someone else brings a claim against us because of information you put into ForemanPay, a pay slip you shared, or how you paid or classified your crew, you agree to cover our reasonable costs and losses from that claim. This does not apply to the part of a claim caused by our own fault.
Some laws give you rights that an agreement cannot take away. These terms do not change those rights.
16. Governing law
The laws of the State of New York, USA, apply to these terms, wherever you live. Any court case about these terms or about ForemanPay must be brought in a state or federal court in the State of New York. You and we both accept those courts.
Please write to us first. Most problems can be solved by email.
17. Changes to these terms
We may update these terms. We will post the new version on this page with a new effective date. If a change is important, we will also tell you in the app or by email before it takes effect.
If you keep using ForemanPay after the new date, you accept the new terms. If you do not agree, cancel your subscription and stop using ForemanPay.
18. General
These terms and the Privacy Policy are the whole agreement between you and us about ForemanPay. If a court finds that part of these terms cannot be enforced, the rest still applies. If we do not act right away when these terms are broken, we can still act later.
You may not pass your account or these terms to someone else. If ForemanPay is ever handed to a new operator, these terms move with it, and we will tell you by email or in the app.
